Welcome to the Ohio Arts Council’s Art$Work Web site (“site”) developed by the Ohio Arts Council (“OAC,” “We,” “Us,” “Our”). The purpose of this site is to allow job seekers (“Job Seeker” or “User”) to review employment, intern and volunteer postings (“Postings”) made by various organizations (“Job Poster,” “Company,” or “User”). This Terms and Conditions of Use (“Agreement”) is made between Us and You, the user of the Art$Work Web site (“site”). Use of this site is provided to Users subject to this Agreement.


I.   User Agreement

By using this site (www.oac.state.oh.us), and the resources and links therein, the User hereby agrees to be bound by all of the terms and conditions contained in this Agreement. We reserve the right to change the terms of this Agreement and will notify Users of any such changes through this online posting. The User’s continued use of the site shall constitute his/her acceptance to be bound by any such changes.

Furthermore, the User acknowledges and accepts that OAC is not responsible for any materials or viruses accessed, located, or stored on other internet Web sites, nor is it liable for any inaccurate, defamatory, offensive, or illegal materials found on this or on other linked internet Web sites, and that the risk of injury from viewing, hearing, downloading, linking to, or storing such materials rests entirely with the User.


II.   Information Disclaimer (AS IS Clause)

Due to ongoing changes and improvements to Internet applications and public information postings, as well as human error, the OAC cannot warrant that the information contained in the site is in every respect accurate, complete, or current, and it is not responsible for any errors or omissions or for the results obtained from the use of such information.

In addition, We cannot warrant that the information contained in any linked external Web sites is in every respect accurate, complete, or current, and We are not responsible for any errors or omissions or for the results obtained from the use of such information. Furthermore, links from the OAC Web site to other Web sites do not constitute an official endorsement by the OAC of the materials contained on such Web sites. These links are provided for informational purposes only. The OAC does not control these Web sites and is not responsible for their content.


III.   Unacceptable Uses

Users are solely responsible for any and all acts and omissions that occur while using this site and agree not to engage in unacceptable use of the site, which includes, but is not limited to, use of the site to: (a) post, disseminate, store or transmit unsolicited messages, chain letters, or unsolicited commercial email (also known as “spam”); (b) post, disseminate, or transmit material that, to a reasonable person, may be abusive, obscene, pornographic, defamatory, harassing, grossly offensive, vulgar, threatening, or malicious; (c) post, disseminate, store, or transmit files, graphics, software, material, or other content that actually or potentially infringes the copyright, trademark, patent, trade secret, intellectual property rights, or rights of privacy or publicity of any person or instruct any person how to do so; (d) create a false identity or to otherwise attempt to mislead any person as to the identity or origin of any communication; (e) post, disseminate, store or transmit viruses, Trojan horses, or any other malicious code or program; (f) interfere with or disrupt the site or the servers or network connected to provide service to the site; (g)provide or post instructional information about illegal or unlawful activities; (h) intentionally or unintentionally violate any applicable local, state, national, or international law; (g) engage in outside commercial or business activities with the express written consent of the OAC; and/or (h) engage in any other activity deemed by the OAC, in its sole discretion, to be unacceptable when using this site or in conflict with the spirit or intent of this Agreement.

As stated in Our Privacy Policy, We will not routinely attempt to match Your personally identifiable information to Your usage of the site or to other information in Our possession. However, if there are instances where We, in Our sole discretion, suspect or determine that the site is being used for any unacceptable, inappropriate, or illegal purposes, information relating to a User’s use of this site may be disclosed to other parties as We deem appropriate.


IV.   Passive Conduit

The information set forth in this site is furnished free of charge to Job Seekers and Job Posters and is based on information believed to be reliable. Users understand that the OAC is a passive conduit for the online distribution and publication of information submitted by others and has no obligation to screen information in advance and is not responsible for screening or monitoring any material posted by others, such as Job Posters, or for the materials exchanged between Job Posters and Job Seekers. The OAC does not verify, confirm, investigate, or corroborate any of the employment, posting, or background information that is provided to us by Job Posters. Job Seekers assume sole risk and responsibility for responding to, answering and investigating all job posted on this site, and for meeting or interviewing with any Job Posters or individuals associated with said Postings.


V.   Governing Law and Forum

This Agreement is made in, and shall be governed by, the laws of the State of Ohio. All actions, claims, or disputes arising under or relating to this Agreement shall be brought in the state courts of Columbus, Ohio exclusively. You irrevocably submit and consent to the exercise of subject matter jurisdiction and personal jurisdiction over You by the state courts in Ohio. You hereby irrevocably waive any and all objections which You may now or hereafter have to the exercise of personal and subject matter jurisdiction by the state courts in Ohio and to the venue of any such suit, action, or proceeding brought in any state court in Columbus, Ohio.
